Terms and Conditions

In these terms and conditions "we", "our" and "us" means In Stock, "you" refers to you the customer.

"Dollar" constitutes New Zealand dollars only.

These terms and conditions together with your order constitute the entire contract between In Stock and the customer. No other external terms and conditions are applicable to this website and business. In stock may change these terms and conditions at anytime at our sole decision. These terms and conditions, however, will not affect your rights under Consumer Guarantee Act 1993 and Fair Trading Act 1986.

Acceptance of terms and conditions
The terms and conditions are the terms on which In Stock offers you access to the services of our website. By registering as a member with us, or purchasing products from us, you are accepting these terms and conditions. If you do not accept these terms and conditions, you must refrain from using the services. By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen years old.

New Zealand sales only
We only sell and ship Products within New Zealand. We do not make deliveries outside of New Zealand.
Therefore all prices are in New Zealand dollars. All prices are GST inclusive, unless otherwise stated.

Designed for residential purpose
Unless otherwise stated (e.g. office chair), all of our products are designed for home / residential purpose only. Using them in a business may void the warranty.

Payment methods and processing times
We currently accept payments using credit card facilities, bank deposit or cash on pick up (not delivery!!).
Payments will not be processed until all applicable information has been received by In Stock. Payments are not cleared on weekends or public holidays, please ensure sufficient funds are available on credit cards for payment to be processed on the next business day.
If your payment is not received within 3 working days from the date that you receive your order confirmation, In Stock reserves the right to cancel the transaction.
In Stock also reserves the right to change prices for products displayed on www.InStock.co.nz at any time without notification.
The name that will appear on your statement is In Stock.

Delivery
In Stock will make every attempt to dispatch your item as soon as possible on the same or next working day of full payment being received. It should take between 1 – 5 working days for items sent with courier to be delivered. For all transport items you should hear from the transport provider within 5 days of dispatch to arrange the delivery or collection directly with you.

Getting everything delivered on time is important to us, however as we use a third party shipping company we cannot guarantee a specific delivery time. We are not liable for any loss, cost or expense caused by delay in delivery. All estimated delivery times are in working days and exclude weekends and/or public holidays.

If your item arrives damaged, please DO NOT SIGN for the delivery – the courier/transport should return the goods to the us. Please then contact us to arrange for an alternative unit to be delivered. Once signed for delivery, you have accepted that your item has arrived in good condition.

Our products all come flat-packed in carton boxes, meaning we are able to reduce labour and delivery/storage costs. The furniture is designed to be packed unassembled. Ultimately, this means that you get the lowest price possible!

Returns and Refunds
We do not have to refund so please choose carefully. But we will refund you in full (including shipping) upon your request in below circumstances:

(1) We have made significant and substantial error(s) in description or image (s)
(2) After payment is cleared and all necessary information is provided, we fail to dispatch order within 10 working days or within the dispatch time frame stated in sales, whichever is longer.
(3) The product is illegal or forbidden by law to sell in New Zealand
(4) Other situations that the consumer guarantee act and/or the fair trading act require that we shall provide a full refund.

Product must be returned with all accessories, package, tags and manuals in a clean and tidy condition before refund can be issued. All returns must obtain a consent from us first, otherwise your refund request may be declined.

Warranty Policy
In Stock’s warranty policy covers our products for 12 months (or otherwise stated upon sales) on a "parts only" base from the purchase date, for residential customers only. Warranty claims cover any fault, defect or failure occurring as a result of the manufacturing process. Damage or faults occurring as a result of misuse, accident, or wear and tear is not covered by our warranty policy.

If the goods are being purchased for a business purpose then the purchaser acknowledges that the Consumer Guarantees Act will not apply.

Unless otherwise stated (e.g. office chair), all of our products are designed for home / residential purpose only. If the goods are being purchased for a business purpose, please inquiry about warranty term prior to your purchase.

If you feel that your purchase has a fault that is covered under warranty please contact us, including as much detail as possible (including a photo of the issue if possible or applicable) so that we can assess the problem and advise you of a solution.

(1)We may decide to repair, replace or refund the product in case of a valid warranty claim.
(2)Warranty period starts from the date of purchase, not the unpack date or any other dates. Repair or replace does not extend this period.
(3)Product that is returned under warranty must be able to show the problem. In some circumstances where returning a product to us is obviously unsuitable, we may not require you to return the product.
(4)Warranty settlement - in some cases, if both you and us agree to settle a product issue with partial refund, our warranty responsibility to this particular product is waived from the date this agreement is reached.
(5)After a full refund for a particular product, buyer must stop using and dispose that product immediately. We will not be responsible for anything that happens after we issue a full refund.


Consumer Guarantees Act 1993
The Consumer Guarantee Act sets out minimum standards for goods sold by In Stock. Your rights set up by this Act is fully supported by us, unless both parties (you and us) have reached an agreement otherwise. This Act does not apply to trade customers (who buy products with an intention of using them in a business). Trade customers are protected by Fair Trading Act 1986.

Fair Trading Act 1986
The Fair Trading Act is designed to protect the customer being misled, either intentionally or unintentionally. This applies to all aspects of the promotion and sale of goods and services including: pricing; where the product was made; where the product is from; the meeting of New Zealand safety standards; availability of products in store and the sales techniques used. The Commerce Commission enforces the Fair Trading Act.
